What is binding advice?

Binding advice is a formal form of business mediation. In this process, a neutral third party, our advisor, makes the decision. The advice is binding for both parties in almost all cases. This is an efficient way to resolve a dispute. Since 2006, Result ADR has been offering binding advice, led by experienced and expert advisors.

Why binding advice?

If you're unable to resolve a business conflict on your own, binding advice can offer a solution. In this form of mediation, you hand over the process and the decision to an independent third party. This approach has several key advantages. For instance, the parties select their own advisor(s) with specialized knowledge relevant to the conflict. The procedure is only minimally formalized, allowing for a more flexible and informal process, which can be tailored in consultation with the parties involved.

How does a binding advice process work?

Initial agreements: The parties and the binding advisor jointly establish the agreements and framework for the process.

Investigation and analysis: A research phase follows. Our advisor gathers and analyzes all relevant information and documentation related to the conflict.

Written submission: Both parties submit their positions and evidence in writing to the advisor. During step 1, agreements were made regarding the number of written rounds, deadlines, and the method of presenting evidence.

Decision-making: The advisor evaluates the submitted information and arrives at a binding judgment, which is final in most cases. This formally resolves the conflict.
