Why employment mediation?

How employment mediation works

A neutral and independent mediator guides both parties toward a solution that works for everyone. Mediation is voluntary and can be ended at any time by any party or the mediator. The process concludes only after all options have been explored and a clear resolution is reached.

Contact with the case manager


The Result ADR case manager contacts both employer and employee to explain the process and connect them with the mediator.

Preliminary conversations


Both parties can have confidential discussions with the mediator before mediation begins to discuss the process and approach.

Online intake (optional)


If no preliminary meetings are held, both parties complete a digital questionnaire to outline the issues and topics they wish to address.

Start of the mediation


The first mediation session takes place at a convenient location. A mediation agreement is signed, ensuring voluntariness and confidentiality. The mediator facilitates a respectful dialogue where everyone is heard.

Mediation sessions


Interests of both parties are explored, and potential solutions are discussed. Separate meetings may be held if necessary. Some conflicts are resolved in a single session, while others require multiple meetings.

Documenting the solution


Agreements are recorded in a settlement agreement or memorandum of understanding. This may include new work arrangements or mutual termination of employment. Written agreements are legally binding.

Completion and reporting


The mediator updates the referring party throughout the process and issues a closure notice once mediation is complete. If needed, a new mediation agreement can be initiated in the future.
