What is employment mediation?

An employment conflict between employer and employee consumes a lot of time, energy, and money for all parties involved. Employment mediation helps get a stalled situation moving again. Through confidential discussions, guided by our neutral mediator, the parties work together to find a resolution.

Because you’re unable to resolve your employment conflict on your own. Or perhaps the company doctor has recommended mediation. And because you want to avoid lengthy and costly legal procedures. Employment mediation can help you reach a solution that is acceptable to both parties.

How does employment mediation work?

A neutral and independent mediator guides the parties toward an outcome that is acceptable to everyone. Mediation is voluntary; it can be ended at any time by either party or by the mediator. The mediator will only conclude the mediation after thoroughly exploring all possibilities for reaching an agreement.

Contact with the case manager: The case manager from Result ADR will contact both the employer and the employee. They will inform both parties about the process and connect you with the mediator.

Preliminary conversations: Both parties can speak confidentially with the mediator before the mediation officially begins. This can include discussions about the process and approach.

Online intake (optional): If no preliminary conversations take place, both parties will receive a digital questionnaire. In this, you can indicate what you would like to discuss during the mediation. This gives the mediator insight into the interests and perspectives of each party.

Start of the mediation: The mediation begins with a meeting at a location that is comfortable for everyone. The first step is signing the mediation agreement, which ensures the voluntary and confidential nature of the process. The mediator facilitates the process neutrally, fostering a respectful conversation where everyone listens to each other.

Mediation sessions: During the mediation, we identify the interests of both parties and explore various possible solutions. The mediator may also speak with each party separately to help move the process forward. Sometimes, a single session is sufficient; other times, multiple sessions are needed.

Documenting the solution: The employment mediator records the agreed-upon terms in a settlement agreement or a memorandum of understanding. This could include new work arrangements or the mutual termination of the employment contract. The documented agreements are binding.

Completion and reporting: The mediator keeps the referring party informed of the process and sends a termination notice to all parties once the mediation is completed. If further mediation is needed later, a new mediation agreement will be created.
